Writing a will for Shariah Inheritors
Question:- Our maternal grandfather has passed away. He had a house in which our maternal grandmother lives. His heirs include a widow, his 4 daughters and 1 son. Our maternal grandfather once said in his lifetime to give his daughters one lakh rupees each, but he did not express it. My question is that will his daughters be given one lakh rupees each, or will all of the inheritance be distributed according to the Shari'ah distribution?
Answer:- If the inheritance were distributed among the daughters during his lifetime, then it was necessary that the daughters were to be given the due possession at that time. Merely saying these words would not give them the possession. Now, it will be necessary to distribute it equally among them after his death. However, if a father leaves a will for his daughters, then it would not be valid without the permission of other heirs. This is because daughters are heirs, and according to the hadith if a will is made for an heir, it would not be valid without the permission of other heirs.
